Terms of Use.
The agreement between you and Considus for using Catchlight and this website. In plain English, because terms you cannot read are not really terms.
These terms are the agreement between you and Considus when you use the Catchlight app or this website.
The most important thing: Catchlight is built so that only you can unlock your data, using your private phrase. If you lose that phrase, no one, including us, can recover your data. Keep it somewhere safe.
Catchlight is free to download. There is an optional paid subscription, which is sold and managed by Apple.
Using the app or the website means you accept these terms. If you do not agree with them, please do not use the app or the website.
Who we are
Catchlight is published by Considus, a sole trader based in England. References to “we”, “us” and “our” mean Considus.
Contact address: Considus, Unit 168318, PO Box 7169, Poole, Dorset, BH15 9EL, United Kingdom. For any questions about these terms, contact us at [email protected].
What these terms cover
These Terms of Use apply to the Catchlight app for iOS and to the website at catchlight.app. They work alongside our Privacy Policy, which explains how we handle the limited personal data we hold.
For the app, Apple’s standard Licensed Application End User License Agreement (the “Apple Standard EULA”) also applies to your download from the App Store. These terms add to it. Where these terms say more than the Apple Standard EULA, these terms apply in addition.
Your licence to use Catchlight
We grant you a personal, non-exclusive, non-transferable, revocable licence to download and use Catchlight on Apple devices that you own or control, for your own use, in line with these terms and the App Store’s own terms.
Catchlight’s source code is also released as open source under the Apache License 2.0. You are free to use the source code under that licence. That is separate from your use of the app you install from the App Store, which is covered by these terms.
Your privacy phrase and your data
This is the most important part, so we say it plainly.
- When you set up Catchlight, the app creates a private phrase (a 12-word mnemonic) on your device. Your notes, reminders and other content are encrypted with a key derived from that phrase.
- Only you hold that key. We never receive it and we keep no copy.
- This means that if you lose or forget your privacy phrase, your data cannot be recovered by anyone, including us. We cannot reset it, work around it, or restore your data for you.
- You are responsible for keeping your phrase safe, and for keeping your own backups, for example an export or the optional cloud folder that you control. We are not responsible for data you lose because a phrase is lost, or because of a problem with a device or a third-party cloud service you choose to use.
This is a deliberate part of how Catchlight protects your privacy, not a limitation we are able to remove.
Subscriptions and payments
Catchlight is free to download. Some features may require an optional paid subscription.
- Any subscription is sold by Apple through your Apple Account, not by us. Payment, billing and renewals are handled by Apple under Apple’s terms.
- A subscription renews automatically at the price shown at purchase, unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel a subscription in your Apple Account settings.
- We never see or store your card or payment details. Any refunds are handled by Apple under Apple’s policies.
Acceptable use
Please use Catchlight and the website lawfully and as intended. Do not try to break, bypass or probe their security, interfere with how they work, or use them to break the law or to infringe anyone else’s rights.
We may suspend or withdraw access if these terms are seriously or repeatedly broken. Because we hold none of your app data, in practice this concerns the website and any support channel you contact us through.
The website
catchlight.app is provided for information about Catchlight. We work to keep it accurate and available, but we provide it “as is” and may change or remove content at any time. It may link to third-party sites that we do not control and are not responsible for.
Intellectual property
The Catchlight and Considus names, logos and brand are owned by Considus and may not be used without our permission. The app’s source code is licensed under the Apache License 2.0. The text and design of this website are owned by Considus, except where we say otherwise.
Disclaimers and your rights
- Catchlight and the website are provided “as is” and “as available”. To the extent the law allows, we do not warrant that they will be uninterrupted or error-free.
- Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud.
- Nothing in these terms affects your statutory rights as a consumer under UK law.
- Subject to the above, and to the extent the law allows, we are not liable for loss of data arising from a lost privacy phrase or from a third-party service, or for indirect or unforeseeable loss.
Apple and the App Store
These terms apply to your use of the Catchlight app in the following ways that Apple requires us to set out.
- These terms are between you and Considus only, not Apple. Apple is not responsible for Catchlight or its content.
- Apple has no obligation to provide any maintenance or support for Catchlight. Any questions about the app should come to us at [email protected].
- To the extent the law allows, Apple gives no warranty for the app. If the app fails to meet any applicable warranty, you may tell Apple, and Apple may refund any purchase price; otherwise Apple has no other warranty obligation for the app.
- Apple is not responsible for handling any claims about the app, including product liability claims, claims that it does not meet a legal requirement, and consumer protection claims. Apple is not responsible for third-party claims that the app or your use of it infringes intellectual property rights; we are responsible for those, as these terms set out.
- You confirm that you are not in a country subject to a US Government embargo or designated by the US Government as “terrorist-supporting”, and that you are not on any US Government prohibited or restricted-party list.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and may enforce them against you.
Changes to these terms
We may update these terms from time to time. The version number and effective date at the top show the current version. We will make material changes that affect the app or a subscription clear. Continuing to use Catchlight or the website after an update means you accept the updated terms.
Governing law
These terms are governed by the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, this does not affect any right you have to bring proceedings in the country where you live.
We have kept these terms as short and plain as we can. They exist to be fair and clear, not to bury anything.
